Title IX FAQs
Tyler Junior College seeks to eliminate sex discrimination and sexual harassment by educating the college community, including supervisors and faculty members about what constitutes sex discrimination and sexual harassment, how to prevent it and how to report it.
The FAQs provided help answer basic questions about Title IX and each person’s role in preventing it.
- What are some examples of sexual misconduct and harassment?
Inappropriate behavior may include:
- Sexual jokes, innuendoes, gestures
- Unwanted flirtation, advances, or propositions
- Pressure for sex
- Display of sexually suggestive objects/visuals
- Display/transmission of sexually suggestive electronic content
- Any unnecessary, unwanted physical contact
- Sexual assault (if this occurs, call the Campus Safety at 2222 or Tyler Police at 911 immediately and maintain evidence)
- What should I do if I feel I have been sexually harassed?
- Document the problem behavior: date, time, place, witnesses, specific behaviors
- Tell the harasser that the behavior is offensive and that you want it to stop
- Seek counseling and personal support from Support Services at 903-510-2041.
- File a complaint with the Office of Human Resources by calling 903-510-2307 or e-mailing firstname.lastname@example.org.
- What about false allegations?
Sanctions may be imposed on individuals who knowingly or with reckless disregard for the truth make false accusations of sexual misconduct. Just because a complaint cannot be proven does not mean that it is false.
- Is sexual misconduct only male to female? Supervisor to employee? Faculty to student?
Sexual misconduct occurs when individuals feel they are the recipients of unwanted sexual attention or behavior. Sexual harassment can happen to or be perpetrated by anyone against anyone else: women, men, students, faculty, staff, supervisors, employees, volunteers, and vendors.
- Can I file a confidential complaint?
The College cannot promise complete confidentiality. Each situation is resolved as discreetly as possible. Tyler Junior College is obligated to follow up on all allegations. There are times that a one-on-one conversation with the alleged harasser can resolve the situation without revealing the complainant's identity. If this doesn't work, then it is often necessary to reveal the complainant's identity to conduct an investigation.
- What is the purpose and possible outcome of an investigation?
The purpose of the investigation is to evaluate the allegations of sexual misconduct, formulate a response to address the situation, and follow up to ensure that recommended actions have been taken. Outcomes can include: no finding of misconduct, finding of inappropriate behavior, finding of misconduct, or finding of false allegations. The ultimate goal is to stop the misconduct.
- Who is typically involved in an investigation?
Campus Safety and the Director of Judicial Affairs will conduct the investigations relating to students. Human Resources will assist in allegations involving faculty and/or staff. The charged party, the Executive Director of Human Resources and the Vice President of Students will be notified of the allegation. Management, the department chair/unit director, and dean/ vice president may also be notified. Information will only be shared with individuals who have a need to know.
- What if I am retaliated against?
Individuals who report sexual misconduct or who are involved in the investigation as witnesses are protected against retaliation by college policy as well as state and federal law. The College will take appropriate corrective action toward those individuals who retaliate against someone because he or she filed a complaint, encouraged someone to file a complaint, served as a witness in an investigation, or otherwise participated in an investigation. - What should I do if I feel in danger?
Whether you are a faculty member, a staff member, or a student, if something has occurred that causes you to fear for your personal safety, contact Campus Safety at 903-510-2258 for non-emergency calls and 903-510-2222 for emergence calls or the local police at regional campuses. Once you are safe contact TJC Office of Human Resources immediately at 903-510-2307 or the TJC Office of Student Affairs at 903-510-2525. If you are a student and feel in danger in the academic environment, after you contact Campus Security at 2222, and then contact the Office of Human Resources at 903-510-2307 or the TJC Office of Student Affairs at 903-510-2525.
